Property for sale

A solicitor can provide the complete service from instruction to sell to settlement of the transaction. Our basic rate of commission is 1% of the sale price subject to a minimum fee of £350 (our commission rate may change in certain circumstances, such as accompanied viewing). This commission includes the following:-

  • Personal visit to your property.
  • Advice regarding the best price likely to achieved, title deed conditions and best method of advertising.
  • Preparation of Schedules of Particulars for Sale.
  • Inclusion in our "Property List".
  • Provision and erection of "For Sale" notice, if so desired.
  • Window display in our office.
  • Arranging press advertisements and inclusion of details (press advertisements are charged by us at cost and we make no further charge in respect of these).
  • Handling enquiries and negotiating offers.

Legal Services - Sales

Once you have received an offer for your property, we then come to the matter of conveyancing. Our conveyancing charges are separate from our estate agency charges and if you have any questions about these please do not hesitate to ask.

Our conveyancing service in respect of selling includes:-

  • Completing missives (the contract). The missives form the core of the transaction and once missives are concluded there is then a binding contract based on the missives. The date of entry (the date of settlement of the transaction) is usually set for some four weeks ahead of the date of the offer to enable us to complete all the necessary paperwork timeously but it can vary according to the wishes of the seller or the purchaser and is usually negotiated between the two parties.
  • Arranging for discharge of your mortgage with your Bank or Building Society (if you have one).
  • Exhibiting the title to the purchaser's solicitors and dealing with their enquiries regarding the same.
  • Obtaining local authority Property Enquiry Certificate and exhibiting the same to the purchaser's solicitors.
  • Completion of the transaction.

Legal Services - Purchases

The position with regard to missives is the same with purchasing a property as it is with selling. Once missives are concluded there is then a binding contract. We would always advise you to ensure that monies, loans etc. are all in place before offering for a property. Penalties for failure to complete a transaction when purchasing can be severe and we are always happy to discuss the position in this respect with you.

Our conveyancing service in respect of purchasing includes:-

  • Advice on availability of the type of property you are seeking.
  • Advice on offers.
  • Arrangements for survey and advice on the types of survey available.
  • Advice on property insurance.
  • Completing missives.
  • Examining the title to ensure it is good and preparation of the deed in your favour.
  • Preparation of your mortgage deed.
  • Completion of the transaction.
  • Storage facilities for your title deeds when returned from Register House (if no mortgage). If you have a mortgage title deeds are generally held by your lender.

Please note that all of the above are only a general guideline to a transaction. Other matters can arise (such as onerous title conditions) but we will always use our best endeavours to settle transactions timeously. Our client's interest will be fundamental when dealing with house sales and purchases.
